Yet, nine months later, court filings in the Supreme Court of Western Australia value her probate estate at just around A$472,000 (approximately £233,000)—a figure that has sparked outrage and speculation among her relatives about where the bulk of her hard-won money has vanished.

At the epicenter of this escalating legal war is Giuffre’s estranged husband, Robert Giuffre, a former mixed martial arts instructor whom she married in 2002 after he helped her escape Epstein’s world. The couple, parents to three children—sons Christian (now 20) and Noah (19), and a minor daughter—separated amid acrimonious divorce proceedings initiated shortly before her death. Giuffre had accused Robert of domestic abuse and financial control, claiming he had not worked since 2017 and was living off her compensation payments. In the weeks leading up to her suicide, she reportedly expressed a dying wish—in an informal email to her accountant—that Robert receive “not a dime,” with assets directed instead to her children, family members, and close supporters.

Under Western Australian intestacy laws, however, Robert—as her legal spouse since the divorce was incomplete—could be entitled to a lump sum plus up to one-third of the estate. Challenging the sons’ bid are Giuffre’s longtime Perth lawyer Karrie Louden and former carer Cheryl Myers, who claim an unsigned draft will and verbal instructions from early 2025 naming them as executors while explicitly excluding Robert. The sons counter that their mother lacked “testamentary capacity” due to her deteriorating mental health and that Louden and Myers unduly influenced her.

A key complication is the Witty River Family Trust, established in 2020 with Virginia and Robert as co-directors holding equal shares. Much of her settlement money—including portions from the Prince Andrew deal, Epstein’s victim fund, and other claims—is believed to have been placed here for asset protection and tax purposes. Trusts often require mutual consent for major decisions, raising questions about whether funds were spent, transferred, or dissipated during the marriage. Family sources have called for a forensic audit, with one telling media outlets: “If it’s found that Robert knew where the missing fortune is, he will certainly have some explaining to do.”

In late November 2025, a court hearing signaled Robert might join the proceedings, potentially as a party or guardian for their minor daughter. Registrar Danielle Davies appointed independent administrator Ian Torrington Blatchford temporarily to oversee ongoing lawsuits Giuffre was involved in at her death, including appeals and defamation matters tied to Epstein associates.
